In the operating model described in this document, the buyer and the seller negotiate directly with each other, while payment, delivery, the handover of products, and the completion of the transaction take place outside the platform.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz does not purchase or resell, on its own behalf, the products advertised by users, nor does it become a party to contracts concluded directly between them simply by virtue of hosting or promoting the advertisements.<\/span><\/p><p><span style=\"color: #000000;\">These clarifications do not exclude the legal obligations incumbent upon the Operator in its capacity as the provider of the platform.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">2. Definitions<\/span><\/h2><p><span style=\"color: #000000;\">For the purposes of these Terms and Conditions:<\/span><\/p><ul><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Platform \/ Website<\/strong> \u2013 the website <a style=\"color: #000000\" href=\"https:\/\/motobiz.ro\/en\/\" target=\"_self\">www.motobiz.ro<\/a> and the functionalities made available through it.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Operator<\/strong> \u2013 MOTO BUSINESS S.R.L., the company that manages MotoBiz.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>User<\/strong> \u2013 any person who accesses or uses the Platform.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Member<\/strong> \u2013 the user who holds an account on the Platform, if this functionality is available.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Listing<\/strong> \u2013 content published by a user for the purpose of presenting a vehicle, a motorcycle, a part, an accessory, or any other offer permitted by the Platform.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Seller<\/strong> \u2013 the user who publishes an ad or offers a product for sale.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Buyer<\/strong> \u2013 the user who contacts a seller with a view to a potential purchase.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Professional seller<\/strong> \u2013 an authorized individual, a commercial company, or any other person acting for purposes related to their commercial or professional activity.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Consumer<\/strong> \u2013 a natural person acting for purposes outside their commercial or professional activity.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Content<\/strong> \u2013 advertisements, photographs, texts, technical data, messages, and other materials uploaded or transmitted via the Platform.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Promotion services<\/strong> \u2013 paid options through which a user can obtain additional visibility for an advertisement, subject to the terms displayed prior to purchase.<\/span><\/li><li class=\"translation-block\"><span style=\"color: #000000\"><strong>Terms and Conditions<\/strong> \u2013 this document, together with the rules and policies to which it refers.<\/span><\/li><\/ul><p>\u00a0<\/p><h2><span style=\"color: #000000;\">3. Acceptance of terms<\/span><\/h2><p><span style=\"color: #000000;\">By accessing and using the Platform, the user confirms that they have had the opportunity to consult this document.<\/span><\/p><p><span style=\"color: #000000;\">If the user creates an account, posts an ad, or purchases a promotional service, acceptance of the terms is effected through the mechanism provided in the relevant interface, prior to carrying out the respective action.<\/span><\/p><p><span style=\"color: #000000;\">A user who does not agree with these terms must cease using the functionalities for which their acceptance is required.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz may update the terms in accordance with the conditions set out in the section regarding amendments to the document. Such amendments shall not negate rights already acquired, nor shall they retroactively alter existing contracts, except in circumstances permitted by law.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">4. Eligibility and User Accounts<\/span><\/h2><p><span style=\"color: #000000;\">The platform may be used by individuals and legal entities that have the legal capacity to use the services offered and to perform the actions they undertake.<\/span><\/p><p><span style=\"color: #000000;\">If creating an account is required for certain functionalities, the user must provide accurate, complete, and up-to-date information.<\/span><\/p><p><span style=\"color: #000000;\">Users agree to:<\/span><\/p><ul><li><span style=\"color: #000000;\">not to create accounts using another person\u2019s identity without authorization;<\/span><\/li><li><span style=\"color: #000000;\">not to provide false information regarding their identity or professional status;<\/span><\/li><li><span style=\"color: #000000;\">to maintain the confidentiality of authentication credentials;<\/span><\/li><li><span style=\"color: #000000;\">not to allow the use of the account for illegal or fraudulent purposes;<\/span><\/li><li><span style=\"color: #000000;\">to inform MotoBiz if they suspect unauthorized access to the account;<\/span><\/li><li><span style=\"color: #000000;\">not to attempt to compromise the security or functioning of the Platform.<\/span><\/li><\/ul><p><span style=\"color: #000000;\">If a user acts on behalf of a company, they declare that they have the right to represent it or to publish advertisements on its behalf.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz may request additional information when there are objective grounds for verification, in compliance with data protection legislation.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">5. The role of MotoBiz and the relationship between users<\/span><\/h2><p><span style=\"color: #000000;\">MotoBiz provides the online infrastructure for publishing and viewing listings, and for facilitating contact between users, within the scope of the available functionalities.<\/span><\/p><p><span style=\"color: #000000;\">In the current model described by these terms:<\/span><\/p><ol><li><p><span style=\"color: #000000;\">the user posts an ad;<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">interested persons contact the seller directly via the available means;<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">the parties discuss the price and the terms of the transaction;<\/span><\/p><\/li><li><p><span style=\"color: #000000;\">The payment, delivery or handover of the product, and the completion of the transaction are arranged directly by the parties, outside the Platform.<\/span><\/p><\/li><\/ol><p><span style=\"color: #000000;\">MotoBiz nu stabile\u0219te \u00een numele p\u0103r\u021bilor pre\u021bul final, nu \u00eencaseaz\u0103 pre\u021bul produselor \u0219i nu organizeaz\u0103 plata sau livrarea acestora \u00een cadrul modelului descris aici.<\/span><\/p><p><span style=\"color: #000000;\">Unless the Operator expressly states otherwise in relation to a specific service, MotoBiz does not physically verify every product, inspect every vehicle, or guarantee the authenticity, legality, technical condition, ownership, or availability of the items featured in the listings.<\/span><\/p><p><span style=\"color: #000000;\">This description of the Platform\u2019s role does not constitute a general exemption from liability. MotoBiz fulfills its obligations under applicable law, including those related to the processing of notifications concerning illegal content and cooperation with competent authorities.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">6. Publishing advertisements<\/span><\/h2><p><span style=\"color: #000000;\">Listings must pertain to products and offers that fall within the categories accepted by MotoBiz\u2014namely vehicles, motorcycles, automotive and motorcycle parts and accessories, as well as other related categories expressly permitted by the Platform.<\/span><\/p><p><span style=\"color: #000000;\">The user who publishes an ad is responsible for its content and must ensure that:<\/span><\/p><ul><li><span style=\"color: #000000;\">the information presented is accurate, clear, and up-to-date;<\/span><\/li><li><span style=\"color: #000000;\">has the right to offer the product for sale or to publish the advertisement on behalf of the person entitled to do so;<\/span><\/li><li><span style=\"color: #000000;\">the price and essential characteristics are presented without misleading interested parties;<\/span><\/li><li><span style=\"color: #000000;\">the published photographs and materials may be used legally;<\/span><\/li><li><span style=\"color: #000000;\">information regarding condition, defects, mileage, year of manufacture, identification, and compatibility is presented in good faith, as applicable;<\/span><\/li><li><span style=\"color: #000000;\">The legal requirements applicable to the product and the activity being carried out are complied with.<\/span><\/li><\/ul><p><span style=\"color: #000000;\">For vehicles, the user must avoid presenting misleading information regarding the vehicle's identity, history, mileage, damage, documentation, registration status, or other significant characteristics.<\/span><\/p><p><span style=\"color: #000000;\">For parts and accessories, the user must provide, to the extent relevant, information regarding the condition of the product, its compatibility, its origin, and any potential defects.<\/span><\/p><p><span style=\"color: #000000;\">The publication of an advertisement does not constitute a verification or certification of the product by MotoBiz.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">7. Prohibited ads and disallowed content<\/span><\/h2><p><span style=\"color: #000000;\">It is prohibited to publish advertisements or content that:<\/span><\/p><ul><li><span style=\"color: #000000;\">violates applicable legislation;<\/span><\/li><li><span style=\"color: #000000;\">promotes stolen or counterfeit products, or products whose sale is illegal;<\/span><\/li><li><span style=\"color: #000000;\">uses falsified documents, identification serial numbers, photographs, or information;<\/span><\/li><li><span style=\"color: #000000;\">contains fraudulent claims, fictitious prices, or descriptions intended to mislead;<\/span><\/li><li><span style=\"color: #000000;\">infringes intellectual property rights or the rights of other persons;<\/span><\/li><li><span style=\"color: #000000;\">contains personal data of third parties without a legal basis;<\/span><\/li><li><span style=\"color: #000000;\">seeks the fraudulent acquisition of money, banking details, passwords, or other confidential information;<\/span><\/li><li><span style=\"color: #000000;\">redirects users to fraudulent schemes, phishing pages, or illegal services;<\/span><\/li><li><span style=\"color: #000000;\">contains malware, malicious code, or dangerous links;<\/span><\/li><li><span style=\"color: #000000;\">it is duplicated in an abusive manner in order to manipulate results or visibility;<\/span><\/li><li><span style=\"color: #000000;\">it is unrelated to the category in which it is published, or it seeks to manipulate the search system;<\/span><\/li><li><span style=\"color: #000000;\">contains threats, harassment, illegal speech, or other material prohibited by law;<\/span><\/li><li><span style=\"color: #000000;\">violates the specific rules published by MotoBiz.<\/span><\/li><\/ul><p><span style=\"color: #000000;\">It is prohibited to use the Platform to facilitate the theft of vehicles, the illegal sale of components, the falsification of documents, or the evasion of legal obligations applicable to the sale of products.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz may publish additional rules for certain categories of listings, provided that these are consistent with the law and accessible to users.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">8. Obligations of sellers who are individuals or professionals<\/span><\/h2><h3><span style=\"color: #000000;\">8.1. Individual sellers<\/span><\/h3><p><span style=\"color: #000000;\">Individuals must publish accurate information about the products offered and comply with applicable legislation.<\/span><\/p><p><span style=\"color: #000000;\">An individual must assess whether they are selling on an occasional basis for personal purposes, or whether their activity is of a commercial or professional nature. The legal status of the seller is determined based on the actual circumstances and the criteria established by law, rather than solely on the basis of a declaration made within their account.<\/span><\/p><p><span style=\"color: #000000;\">In the case of a transaction between two individuals who are not acting for professional purposes, specific consumer protection rights do not automatically apply in the same way as they would in a contract concluded between a professional and a consumer. Other relevant legal provisions remain applicable.<\/span><\/p><p>\u00a0<\/p><h3><span style=\"color: #000000;\">8.2. Professional sellers<\/span><\/h3><p><span style=\"color: #000000;\">Sellers acting for commercial or professional purposes must comply with the legal obligations relevant to their activities, including those concerning consumer information, taxation, invoicing, product safety, and the conformity of goods, as applicable.<\/span><\/p><p><span style=\"color: #000000;\">When publishing offers directed at consumers, professionals must accurately present their identity and professional status, as well as the mandatory information required by law.<\/span><\/p><p><span style=\"color: #000000;\">Professional sellers must not falsely present themselves as private individuals selling on an occasional basis.<\/span><\/p><p><span style=\"color: #000000;\">Depending on how the Platform operates and on applicable legal obligations, MotoBiz may request certain information for the purpose of identifying and verifying professional sellers.<\/span><\/p><p>\u00a0<\/p><h3><span style=\"color: #000000;\">8.3. Information regarding the seller\u2019s status<\/span><\/h3><p><span style=\"color: #000000;\">Users must provide accurate information regarding the capacity in which they post advertisements.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz may introduce mechanisms for declaring or displaying professional status, to the extent that these are available and necessary.<\/span><\/p><p><span style=\"color: #000000;\">Any status label is based on the information obtained and should not be interpreted as a general guarantee regarding the seller\u2019s reliability, solvency, or conduct.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">9. Contacting sellers and transactions<\/span><\/h2><p><span style=\"color: #000000;\">Users must act in good faith when contacting other users and must not use data obtained through the Platform for illegal purposes, spam, harassment, or unsolicited marketing.<\/span><\/p><p><span style=\"color: #000000;\">Before finalizing a transaction, the buyer is encouraged to verify the seller's identity, relevant documents, the condition of the product, compatibility, and the terms of handover.<\/span><\/p><p><span style=\"color: #000000;\">The parties are responsible for establishing and complying with the terms of the transaction, including:<\/span><\/p><ul><li><span style=\"color: #000000;\">the final price;<\/span><\/li><li><span style=\"color: #000000;\">the method and timing of payment;<\/span><\/li><li><span style=\"color: #000000;\">place and conditions of delivery;<\/span><\/li><li><span style=\"color: #000000;\">transport and delivery;<\/span><\/li><li><span style=\"color: #000000;\">product verification;<\/span><\/li><li><span style=\"color: #000000;\">the necessary documents and formalities;<\/span><\/li><li><span style=\"color: #000000;\">the resolution of disagreements between them.<\/span><\/li><\/ul><p><span style=\"color: #000000;\">MotoBiz does not guarantee that a transaction will take place and is not liable for the non-performance of obligations by either party, insofar as the situation is not attributable to a legal obligation incumbent upon the Operator itself.<\/span><\/p><p><span style=\"color: #000000;\">If a professional seller enters into a contract with a consumer, the seller is subject to the legal obligations applicable to that contract. The presence of the listing on MotoBiz does not negate these obligations.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">10. Safety and Fraud Prevention<\/span><\/h2><p><span style=\"color: #000000;\">MotoBiz advises users to exercise caution when communicating or conducting transactions with unknown individuals.<\/span><\/p><p><span style=\"color: #000000;\">Users are encouraged:<\/span><\/p><ul><li><span style=\"color: #000000;\">to check the product and the documents before making the payment;<\/span><\/li><li><span style=\"color: #000000;\">they should be cautious in the event of urgent requests for money transfers;<\/span><\/li><li><span style=\"color: #000000;\">not to disclose passwords, authentication codes, or confidential banking data;<\/span><\/li><li><span style=\"color: #000000;\">not to access suspicious links received from individuals claiming to represent MotoBiz;<\/span><\/li><li><span style=\"color: #000000;\">to carefully verify the identity and contact details of the person they are speaking with;<\/span><\/li><li><span style=\"color: #000000;\">to retain communications and evidence relevant to the transaction.<\/span><\/li><\/ul><p><span style=\"color: #000000;\">MotoBiz does not request the submission of bank account passwords, and it should not be considered a party to a transaction simply because a user employs the Platform\u2019s name or visual elements.<\/span><\/p><p class=\"translation-block\"><span style=\"color: #000000\">If a user suspects fraud, a fake listing, or a phishing attempt, they can report it to MotoBiz at <a style=\"color: #000000\" href=\"mailto:contact@motobiz.ro\" target=\"_self\">contact@motobiz.ro<\/a> and, where appropriate, to the competent authorities.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz may take reasonable measures to limit fraudulent activities, without guaranteeing that all instances of fraud or violations can be detected before any harm occurs.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">11. Free listings and paid promotion services<\/span><\/h2><p><span style=\"color: #000000;\">MotoBiz may allow the free posting of advertisements, within the limits and under the conditions communicated on the Platform.<\/span><\/p><p><span style=\"color: #000000;\">The operator may also offer paid promotional services, such as highlighting listings or increasing their visibility, should such services be available.<\/span><\/p><p><span style=\"color: #000000;\">Before purchasing a paid service, the user will be presented with relevant information, including the price, duration, main features, and terms and conditions of the service.<\/span><\/p><p><span style=\"color: #000000;\">Promotion services offer only the visibility benefits described in the respective offer. They do not constitute a product certification, a verification of the seller, or a guarantee that the product will sell.<\/span><\/p><p><span style=\"color: #000000;\">If a service is presented as a paid promotion, this nature must be clearly indicated, in accordance with applicable legal requirements.<\/span><\/p><p><span style=\"color: #000000;\">The terms regarding payment, invoicing, cancellation, and potential refunds for promotional services will be communicated prior to purchase and will comply with applicable legislation.<\/span><\/p><p><span style=\"color: #000000;\">If the user is a consumer and purchases a service remotely, their legal rights\u2014including those regarding withdrawal\u2014apply to the extent and under the conditions provided by law. No provision in this document excludes, in advance, any mandatory legal right.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz may modify promotional offers for future orders. Such changes do not retroactively affect services already purchased, except in cases permitted by law or validly agreed upon with the user.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">12. Ad moderation and applicable measures<\/span><\/h2><p><span style=\"color: #000000;\">MotoBiz may analyze listings and other materials when it receives a notification, identifies indications of a violation, or has a legal obligation to intervene.<\/span><\/p><p><span style=\"color: #000000;\">Depending on the nature and severity of the situation, the Operator may take measures such as:<\/span><\/p><ul><li><span style=\"color: #000000;\">requesting clarifications or additional information;<\/span><\/li><li><span style=\"color: #000000;\">correcting or updating an advertisement, with the user\u2019s consent, when appropriate;<\/span><\/li><li><span style=\"color: #000000;\">temporary limitation of visibility;<\/span><\/li><li><span style=\"color: #000000;\">removal or deactivation of the advertisement;<\/span><\/li><li><span style=\"color: #000000;\">temporary suspension of certain functionalities;<\/span><\/li><li><span style=\"color: #000000;\">suspension or closure of the account in justified cases;<\/span><\/li><li><span style=\"color: #000000;\">retaining relevant information and transmitting it to the authorities, when there is a legal obligation.<\/span><\/li><\/ul><p><span style=\"color: #000000;\">The measures will be chosen based on the circumstances, including the severity and frequency of the violation, the risk to users, and the available information.<\/span><\/p><p><span style=\"color: #000000;\">MotoBiz is not obligated to retain an advertisement that violates the law or the Platform\u2019s rules. At the same time, moderation must be carried out in compliance with applicable legal obligations, including rules regarding the transparency of decisions.<\/span><\/p><p><span style=\"color: #000000;\">If a measure is taken as a result of a moderation decision that falls within the scope of the Digital Services Act, MotoBiz will provide the reasoning required by law, as well as information regarding avenues for appeal, to the extent applicable.<\/span><\/p><p>\u00a0<\/p><h2><span style=\"color: #000000;\">13.
