Last update: October 9, 2026

1. General information about the platform

The website www.motobiz.ro is an online classifieds platform dedicated to the automotive and motorcycle sector, including vehicles, motorcycles, spare parts, and accessories.

The platform is managed by:

  • Company name: MOTO BUSINESS S.R.L.
  • CUI: 55466009
  • Trade Register No.: J2026050963007 / 24.08.2026
  • EUID: ROONRC.J2026050963007
  • Registered office: București, Sector 3, Bulevardul Theodor Pallady, nr. 23
  • E-mail de contact: contact@motobiz.ro
  • Website: https://www.motobiz.ro

Throughout this document, MOTO BUSINESS S.R.L. shall hereinafter be referred to as “MotoBiz”, “the Operator”, or “the Platform”.

MotoBiz allows individual and corporate users to publish listings, showcase products and offers, and get in touch with a view to potential transactions.

MotoBiz provides the online space where listings are published. In the operating model described in this document, the buyer and the seller negotiate directly with each other, while payment, delivery, the handover of products, and the completion of the transaction take place outside the platform.

MotoBiz does not purchase or resell, on its own behalf, the products advertised by users, nor does it become a party to contracts concluded directly between them simply by virtue of hosting or promoting the advertisements.

These clarifications do not exclude the legal obligations incumbent upon the Operator in its capacity as the provider of the platform.

2. Definitions

  • Terms and Conditions – this document, together with the rules and policies to which it refers.

3. Acceptance of terms

By accessing and using the Platform, the user confirms that they have had the opportunity to consult this document.

If the user creates an account, posts an ad, or purchases a promotional service, acceptance of the terms is effected through the mechanism provided in the relevant interface, prior to carrying out the respective action.

A user who does not agree with these terms must cease using the functionalities for which their acceptance is required.

MotoBiz may update the terms in accordance with the conditions set out in the section regarding amendments to the document. Such amendments shall not negate rights already acquired, nor shall they retroactively alter existing contracts, except in circumstances permitted by law.

4. Eligibility and User Accounts

The platform may be used by individuals and legal entities that have the legal capacity to use the services offered and to perform the actions they undertake.

If creating an account is required for certain functionalities, the user must provide accurate, complete, and up-to-date information.

Users agree to:

  • not to create accounts using another person’s identity without authorization;
  • not to provide false information regarding their identity or professional status;
  • to maintain the confidentiality of authentication credentials;
  • not to allow the use of the account for illegal or fraudulent purposes;
  • to inform MotoBiz if they suspect unauthorized access to the account;
  • not to attempt to compromise the security or functioning of the Platform.

If a user acts on behalf of a company, they declare that they have the right to represent it or to publish advertisements on its behalf.

MotoBiz may request additional information when there are objective grounds for verification, in compliance with data protection legislation.

5. The role of MotoBiz and the relationship between users

MotoBiz provides the online infrastructure for publishing and viewing listings, and for facilitating contact between users, within the scope of the available functionalities.

In the current model described by these terms:

  1. the user posts an ad;

  2. interested persons contact the seller directly via the available means;

  3. the parties discuss the price and the terms of the transaction;

  4. The payment, delivery or handover of the product, and the completion of the transaction are arranged directly by the parties, outside the Platform.

MotoBiz nu stabilește în numele părților prețul final, nu încasează prețul produselor și nu organizează plata sau livrarea acestora în cadrul modelului descris aici.

Unless the Operator expressly states otherwise in relation to a specific service, MotoBiz does not physically verify every product, inspect every vehicle, or guarantee the authenticity, legality, technical condition, ownership, or availability of the items featured in the listings.

This description of the Platform’s role does not constitute a general exemption from liability. MotoBiz fulfills its obligations under applicable law, including those related to the processing of notifications concerning illegal content and cooperation with competent authorities.

6. Publishing advertisements

Listings must pertain to products and offers that fall within the categories accepted by MotoBiz—namely vehicles, motorcycles, automotive and motorcycle parts and accessories, as well as other related categories expressly permitted by the Platform.

The user who publishes an ad is responsible for its content and must ensure that:

  • the information presented is accurate, clear, and up-to-date;
  • has the right to offer the product for sale or to publish the advertisement on behalf of the person entitled to do so;
  • the price and essential characteristics are presented without misleading interested parties;
  • the published photographs and materials may be used legally;
  • information regarding condition, defects, mileage, year of manufacture, identification, and compatibility is presented in good faith, as applicable;
  • The legal requirements applicable to the product and the activity being carried out are complied with.

For vehicles, the user must avoid presenting misleading information regarding the vehicle's identity, history, mileage, damage, documentation, registration status, or other significant characteristics.

For parts and accessories, the user must provide, to the extent relevant, information regarding the condition of the product, its compatibility, its origin, and any potential defects.

The publication of an advertisement does not constitute a verification or certification of the product by MotoBiz.

7. Prohibited ads and disallowed content

It is prohibited to publish advertisements or content that:

  • violates applicable legislation;
  • promotes stolen or counterfeit products, or products whose sale is illegal;
  • uses falsified documents, identification serial numbers, photographs, or information;
  • contains fraudulent claims, fictitious prices, or descriptions intended to mislead;
  • infringes intellectual property rights or the rights of other persons;
  • contains personal data of third parties without a legal basis;
  • seeks the fraudulent acquisition of money, banking details, passwords, or other confidential information;
  • redirects users to fraudulent schemes, phishing pages, or illegal services;
  • contains malware, malicious code, or dangerous links;
  • it is duplicated in an abusive manner in order to manipulate results or visibility;
  • it is unrelated to the category in which it is published, or it seeks to manipulate the search system;
  • contains threats, harassment, illegal speech, or other material prohibited by law;
  • violates the specific rules published by MotoBiz.

It is prohibited to use the Platform to facilitate the theft of vehicles, the illegal sale of components, the falsification of documents, or the evasion of legal obligations applicable to the sale of products.

MotoBiz may publish additional rules for certain categories of listings, provided that these are consistent with the law and accessible to users.

8. Obligations of sellers who are individuals or professionals

8.1. Individual sellers

Individuals must publish accurate information about the products offered and comply with applicable legislation.

An individual must assess whether they are selling on an occasional basis for personal purposes, or whether their activity is of a commercial or professional nature. The legal status of the seller is determined based on the actual circumstances and the criteria established by law, rather than solely on the basis of a declaration made within their account.

In the case of a transaction between two individuals who are not acting for professional purposes, specific consumer protection rights do not automatically apply in the same way as they would in a contract concluded between a professional and a consumer. Other relevant legal provisions remain applicable.

8.2. Professional sellers

Sellers acting for commercial or professional purposes must comply with the legal obligations relevant to their activities, including those concerning consumer information, taxation, invoicing, product safety, and the conformity of goods, as applicable.

When publishing offers directed at consumers, professionals must accurately present their identity and professional status, as well as the mandatory information required by law.

Professional sellers must not falsely present themselves as private individuals selling on an occasional basis.

Depending on how the Platform operates and on applicable legal obligations, MotoBiz may request certain information for the purpose of identifying and verifying professional sellers.

8.3. Information regarding the seller’s status

Users must provide accurate information regarding the capacity in which they post advertisements.

MotoBiz may introduce mechanisms for declaring or displaying professional status, to the extent that these are available and necessary.

Any status label is based on the information obtained and should not be interpreted as a general guarantee regarding the seller’s reliability, solvency, or conduct.

9. Contacting sellers and transactions

Users must act in good faith when contacting other users and must not use data obtained through the Platform for illegal purposes, spam, harassment, or unsolicited marketing.

Before finalizing a transaction, the buyer is encouraged to verify the seller's identity, relevant documents, the condition of the product, compatibility, and the terms of handover.

The parties are responsible for establishing and complying with the terms of the transaction, including:

  • the final price;
  • the method and timing of payment;
  • place and conditions of delivery;
  • transport and delivery;
  • product verification;
  • the necessary documents and formalities;
  • the resolution of disagreements between them.

MotoBiz does not guarantee that a transaction will take place and is not liable for the non-performance of obligations by either party, insofar as the situation is not attributable to a legal obligation incumbent upon the Operator itself.

If a professional seller enters into a contract with a consumer, the seller is subject to the legal obligations applicable to that contract. The presence of the listing on MotoBiz does not negate these obligations.

10. Safety and Fraud Prevention

MotoBiz advises users to exercise caution when communicating or conducting transactions with unknown individuals.

Users are encouraged:

  • to check the product and the documents before making the payment;
  • they should be cautious in the event of urgent requests for money transfers;
  • not to disclose passwords, authentication codes, or confidential banking data;
  • not to access suspicious links received from individuals claiming to represent MotoBiz;
  • to carefully verify the identity and contact details of the person they are speaking with;
  • to retain communications and evidence relevant to the transaction.

MotoBiz does not request the submission of bank account passwords, and it should not be considered a party to a transaction simply because a user employs the Platform’s name or visual elements.

If a user suspects fraud, a fake listing, or a phishing attempt, they can report it to MotoBiz at contact@motobiz.ro and, where appropriate, to the competent authorities.

MotoBiz may take reasonable measures to limit fraudulent activities, without guaranteeing that all instances of fraud or violations can be detected before any harm occurs.

11. Free listings and paid promotion services

MotoBiz may allow the free posting of advertisements, within the limits and under the conditions communicated on the Platform.

The operator may also offer paid promotional services, such as highlighting listings or increasing their visibility, should such services be available.

Before purchasing a paid service, the user will be presented with relevant information, including the price, duration, main features, and terms and conditions of the service.

Promotion services offer only the visibility benefits described in the respective offer. They do not constitute a product certification, a verification of the seller, or a guarantee that the product will sell.

If a service is presented as a paid promotion, this nature must be clearly indicated, in accordance with applicable legal requirements.

The terms regarding payment, invoicing, cancellation, and potential refunds for promotional services will be communicated prior to purchase and will comply with applicable legislation.

If the user is a consumer and purchases a service remotely, their legal rights—including those regarding withdrawal—apply to the extent and under the conditions provided by law. No provision in this document excludes, in advance, any mandatory legal right.

MotoBiz may modify promotional offers for future orders. Such changes do not retroactively affect services already purchased, except in cases permitted by law or validly agreed upon with the user.

12. Ad moderation and applicable measures

MotoBiz may analyze listings and other materials when it receives a notification, identifies indications of a violation, or has a legal obligation to intervene.

Depending on the nature and severity of the situation, the Operator may take measures such as:

  • requesting clarifications or additional information;
  • correcting or updating an advertisement, with the user’s consent, when appropriate;
  • temporary limitation of visibility;
  • removal or deactivation of the advertisement;
  • temporary suspension of certain functionalities;
  • suspension or closure of the account in justified cases;
  • retaining relevant information and transmitting it to the authorities, when there is a legal obligation.

The measures will be chosen based on the circumstances, including the severity and frequency of the violation, the risk to users, and the available information.

MotoBiz is not obligated to retain an advertisement that violates the law or the Platform’s rules. At the same time, moderation must be carried out in compliance with applicable legal obligations, including rules regarding the transparency of decisions.

If a measure is taken as a result of a moderation decision that falls within the scope of the Digital Services Act, MotoBiz will provide the reasoning required by law, as well as information regarding avenues for appeal, to the extent applicable.

13. Reporting illegal content

Any person may submit a notification regarding an advertisement or other content that they consider illegal.

Notifications may be sent to contact@motobiz.ro, with the subject line “Reporting illegal content,” or via a reporting mechanism provided on the Platform, if available.

To facilitate the analysis of the notification, it is recommended that it include:

  • the most precise identification possible of the reported advertisement or content;
  • a description of the reason why the content is considered illegal;
  • information that allows for an understanding of the situation;
  • contact details of the person submitting the notification, if legally required and necessary;
  • a declaration of good faith regarding the accuracy of the information provided, when required by the applicable mechanism.

MotoBiz will review the notifications received and take the measures required by law, depending on the content and the information available.

Submitting a notification does not guarantee the automatic removal of the content. The decision will be made following an appropriate assessment, in compliance with legal obligations.

Abusive, manifestly unfounded, or bad-faith notifications may be dealt with in accordance with applicable law.

14. Challenging decisions

If MotoBiz removes an ad, restricts content, or takes action against an account, the affected user may request a review of the decision by submitting a request to contact@motobiz.ro, with the subject “Contesting a moderation decision”.

The request must specify the contested decision, the targeted post or account, and the reasons why the user believes the measure should be re-examined.

MotoBiz will re-evaluate the decision based on available information and applicable legal standards. Where a mandatory complaint-handling mechanism—as provided for by digital services legislation—is applicable, it will be implemented in accordance with the requirements of the law.

If the measure is upheld, the user may request clarifications and avail themselves of the legal remedies provided by law, as applicable.

Nothing in this section restricts the right of individuals to notify the competent authorities or to pursue other available legal avenues.

15. Classification, ordering, and promotion of listings

Listings may be displayed and sorted based on criteria such as relevance to the search, category, publication date, user-selected features, or other criteria actually employed by the Platform.

If MotoBiz offers paid promotion that influences the position or visibility of listings, this will be clearly disclosed to users, in accordance with applicable law.

The main parameters used for ranking results, and their relative importance, will be explained in an accessible section, to the extent that such disclosure is required by law.

No promoted listing should be automatically interpreted as being verified, recommended, or guaranteed by MotoBiz.

The operator may modify the classification and display mechanisms to improve the functioning of the Platform, to prevent fraud, or to comply with legal requirements. Mandatory information regarding classification parameters will be updated whenever necessary.

16. Intellectual property and rights regarding content

Rights to the Platform’s own elements—such as the MotoBiz brand, logo, design, texts, and graphic elements created by the Operator—belong to their respective owners and are protected by law.

The user retains the rights they hold over the content they publish.

By publishing an advertisement, the user grants MotoBiz a non-exclusive, royalty-free right—limited to the purpose of the Platform’s operation and valid for the duration necessary to provide the service—to host, technically reproduce, display, and distribute the content within the Platform and through any promotional features selected by the user.

This right does not transfer ownership of the content and does not authorize its use for purposes unrelated to the service, except as permitted by law or separately agreed to by the user.

The user declares that they hold the necessary rights or permissions for the publication of the photographs, texts, trademarks, and other materials included in the advertisement.

If a person believes that an advertisement infringes upon their intellectual property rights, they may contact MotoBiz at contact@motobiz.ro and provide information that allows for the identification of the content and the right being asserted.

MotoBiz will review the complaint and take appropriate measures, in accordance with applicable legislation.

17. Personal Data and Confidentiality

MotoBiz processes personal data in accordance with applicable legislation and the Privacy Policy published on the website.

The data may be processed, as applicable, for account administration, the publication of advertisements, ensuring security, fraud prevention, handling requests, providing promotional services, and fulfilling legal obligations.

Contact details published by users in advertisements may become visible to other individuals, subject to the terms displayed on the Platform. Users should avoid publishing excessive personal information or the data of other individuals without a legal basis.

Users must not use data obtained through the Platform for spam, harassment, unlawful profiling, or other purposes incompatible with the reason for which the data was made available.

Details regarding the rights of data subjects, data recipients, retention periods, and the procedures for exercising these rights are described in the Privacy Policy.

18. Availability and Security of the Platform

MotoBiz makes reasonable efforts to maintain the operation and security of the Platform.

There may be temporary interruptions due to maintenance, updates, technical fixes, security incidents, or other causes beyond the reasonable control of the Operator.

Users must not attempt to access computer systems without authorization, automatically collect data through prohibited methods, bypass security measures, or interfere with the operation of the service.

MotoBiz may implement technical and organizational measures to prevent abuse and to protect the integrity of the Platform.

19. Liability of the Parties

The user is responsible for the legality, accuracy, and currency of the content they publish, as well as for compliance with the obligations incumbent upon them in connection with their activity and transactions.

The seller is responsible for the right to offer the product, the information provided about it, and the obligations incumbent upon them in their relationship with the buyer.

The parties to a transaction are responsible for negotiating and executing the contract concluded directly between them.

MotoBiz does not guarantee the authenticity, condition, quality, safety, legality, or availability of products simply by hosting an advertisement. Furthermore, it does not guarantee the solvency, true identity, or good faith of any individual user, beyond the checks actually performed and disclosed.

No provision in this document excludes or limits MotoBiz’s liability in situations where such an exclusion or limitation is prohibited by law, including in relation to the Operator’s own obligations.

20. Suspension or termination

MotoBiz may restrict access to certain features or suspend an account when there are justified grounds, such as repeated violations of the terms, fraudulent activities, security risks, or legal obligations.

The measure will be proportionate to the situation and will comply with legal obligations regarding information and the provision of reasons, where applicable.

The user may cease using the Platform and, if such functionality is available, may request the deletion of their account under the conditions described in the Privacy Policy and the account rules.

The termination of access does not eliminate obligations that arose previously, nor does it remove legal obligations to retain certain information or documents.

21. Communications and notifications

For general inquiries, complaints, reporting content, or challenging decisions, users can contact MotoBiz at:

E-mail: contact@motobiz.ro

To facilitate the resolution of your request, it is recommended that your message include the link to the listing, its identifier (if available), a description of the issue, and any relevant information.

MotoBiz may communicate information to users regarding account administration, announcements, purchased services, or significant changes to the Platform, using the contact details provided by them, in accordance with the law.

Commercial communications and marketing messages are managed separately, in accordance with applicable legal requirements.

22. Resolution of complaints and disputes

MotoBiz encourages the amicable resolution of issues related to the use of the Platform.

For issues regarding the operation of the service, announcements, or moderation measures, users may contact the Operator at contact@motobiz.ro.

Disagreements between the buyer and the seller regarding payment, delivery, the condition of the product, warranties, or the execution of the transaction must, in the first instance, be addressed to the other party—without prejudice to the right to refer the matter to the competent authorities or courts.

In the case of transactions between professionals and consumers, consumer rights and legal protection mechanisms apply depending on the nature of the contract and the status of the parties.

Information regarding consumer protection and alternative dispute resolution can be found on the website of the National Authority for Consumer Protection, https://anpc.ro, and on the ADR (Alternative Dispute Resolution) platform, https://reclamatiisal.anpc.ro.

For disputes between users, the competent court is determined in accordance with the legal rules applicable to the specific legal relationship.

Nicio prevedere din această secțiune nu limitează drepturile obligatorii ale consumatorilor sau dreptul unei persoane de a se adresa autorităților competente.

23. Amendment of the Terms and Conditions

MotoBiz may modify this document to reflect legislative, technical, commercial, or operational changes.

The updated version will be published on the website, along with the date of the last update.

When the law requires prior information or notification of users, MotoBiz will comply with the applicable requirements.

The amendments apply prospectively, without prejudice to rights already acquired or contracts already concluded, except in cases permitted by law or validly agreed upon.

24. Applicable Law and Final Provisions

This document is governed by Romanian law and the applicable mandatory rules of the European Union.

If a provision is declared void or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.

No provision in these Terms and Conditions shall be interpreted as a waiver of the mandatory rights granted to users by law, or as an exemption of the Operator from its legal obligations.

This document must be read in conjunction with the Privacy Policy, the Cookie Policy, and, where applicable, the specific terms and conditions for promotional services.
